can this be on an angle?

can the top of the suspension be on an angle like this? mine is a little. is this ok?

Yours does seem to be at an angle - especially when you compare it to Brian's picture. cryconfuse

I would be having an inspection and checking the shock situation - just to make sure nothing's amiss. wink

It should be possible to grab the top of the shock and twist it straight. The top and bottom shock bearings allow the shock to twist slightly.
